1. Agreement to Terms
By engaging our services, you agree to these Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Paragon Homes, a division of Paragon Builders (“Paragon Homes,” “we,” “us,” or “our”).
2. Services
We provide custom home building services including but not limited to: custom home design, construction, remodeling, and related services for residential properties in our service area. Our services include collaboration with clients on customized floor plans, material selection, and construction of truly custom homes.
3. Service Area
We serve Fargo, Moorhead, West Fargo, Horace, and surrounding areas in North Dakota and Minnesota. Service availability may vary by location.
4. Design and Consultation Process
Our design process typically includes:
- Initial budget and vision meeting
- Design collaboration with our experienced drafter
- Detailed floor plan development
- Material selection and finishes
- Cost analysis and budget finalization
5. Estimates and Pricing
- All initial consultations and estimates for service are provided free of charge
- We operate on a transparent cost-plus model, where all costs are disclosed to clients
- Estimates are valid for 30 days from the date issued, unless otherwise specified
- Changes to design, materials, or scope may affect final pricing
- Any change orders will be documented and approved before implementation
6. Payment Terms
- Payment schedule will be outlined in your construction contract
- We accept personal checks as our primary form of payment
- Other payment methods may be available upon request
- A payment schedule tied to construction milestones will be established for each project
7. Design Services and Intellectual Property
- Custom home designs created during our design process require payment if the client chooses not to proceed with Paragon Homes for construction
- Design fees will be specified prior to beginning the design process
- All designs, plans, and specifications remain the intellectual property of Paragon Homes until fully paid for
8. Cancellation Policy
- Cancellation terms will be specified in your construction contract
- Deposits for design services may be non-refundable if significant work has been completed
- We reserve the right to terminate services if terms of the contract are not met
9. Warranties and Guarantees
- We provide a 1-year warranty on labor and parts for all new construction
- Specific warranty terms for materials vary by manufacturer
- Warranty coverage may be void if:
- Work is modified by unauthorized personnel
- Recommended maintenance is not performed
- Property is used improperly
- Damage is caused by acts of God, natural disasters, or other external factors beyond our control
10. Client Responsibilities
You agree to:
- Provide accurate information regarding your construction needs and preferences
- Make timely decisions regarding design, materials, and other selections
- Ensure reasonable access to the construction site
- Maintain appropriate insurance on the property during construction
- Make payments according to the agreed-upon schedule
11. Construction Timeline
- Project timelines will be established in your construction contract
- Timelines are estimates and may be affected by weather, material availability, change orders, or other factors outside our control
- We will provide regular updates on construction progress and any timeline adjustments
12. Change Orders
- All changes to the approved plans or specifications must be documented in writing
- Change orders may affect project timeline and cost
- Change orders must be approved by both parties before implementation
13. Liability Limitations
- We are not responsible for pre-existing conditions or issues not directly related to our services
- Our maximum liability is limited to the amount paid for the services provided
- We are not liable for indirect, special, incidental, or consequential damages
- We maintain appropriate insurance coverage as required by law
14. Property Access and Work Area
By contracting our services, you grant us permission to access your property as necessary to perform the requested services. We will take reasonable care to protect your property during construction.
15. Licensing and Compliance
We are properly licensed and insured as required by state law. Our construction practices follow all applicable building codes and industry standards.
16. Subcontractors
- We may use qualified subcontractors to complete certain aspects of your project
- All subcontractors are properly vetted, licensed (where applicable), and insured
- We maintain responsibility for the quality of all work performed by subcontractors
17. Communications and Marketing
We are committed to maintaining open lines of communication throughout your project:
- You will receive regular updates on project progress
- A dedicated point of contact will be assigned to your project
- We will respond promptly to inquiries and concerns
- We use text messaging, phone calls, and email for project communications
17.1 SMS and Email Communications
When requesting an estimate or scheduling a consultation with us:
- You consent to receive SMS text messages about your appointment, project updates, and promotional offers
- You consent to receive email communications including consultation confirmations, educational content about home building, newsletters, and special promotions
- By providing your phone number or email address when requesting an estimate, you consent to receive communications from us through these channels
- Standard message and data rates may apply for SMS communications
- You can opt out of SMS messages at any time by replying “STOP” to any text message
- You can unsubscribe from email communications by clicking the “Unsubscribe” link in any email or by contacting us directly
18. Dispute Resolution
- Any disputes arising from our services will first be addressed through informal negotiation
- If informal negotiation fails, disputes will be resolved through mediation in the state where the project is located
- If mediation is unsuccessful, disputes will be resolved through binding arbitration
- The prevailing party in any legal action shall be entitled to recover reasonable attorney fees
19. Governing Law
These Terms are governed by the laws of the state where the project is located, without regard to its conflict of law provisions.
20. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon providing written notification to clients. Continued use of our services after such modifications constitutes acceptance of the updated Terms.
21. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

23. Complete Agreement
These Terms, along with your construction contract, constitute the entire agreement between you and Paragon Homes regarding our services and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
By contracting our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
